Terms of Service

Effective date: October 3, 2026

Welcome to MerryGo. These Terms of Service ("Terms") are an agreement between you and Harper LLC ("MerryGo," "we," "us") that governs your use of the MerryGo app and website (the "Service"). We've tried to write them in plain language. By creating an account or using the Service, you agree to these Terms. If you don't agree, please don't use the Service.

1. Who can use MerryGo

MerryGo is designed for adults. You must be at least 18 years old, or the age of majority where you live, to create an account. Accounts are created and managed by parents, guardians, teachers, daycare administrators, and other authorized caregivers. Children are the subjects of the memories, not the operators of accounts. If you use MerryGo on behalf of a school, daycare, or other organization, you represent that you have any permissions required by that organization and by applicable law.

2. Your account

You sign in with your email address. You're responsible for keeping access to your email and account secure, and for activity that happens under your account. Please let us know at support@getmerrygo.com if you believe your account has been used without your permission.

3. Your content is yours

The memories you create in MerryGo — your photos, videos, words, and the way you arrange them — belong to you. We don't claim ownership of your content, and nothing in these Terms transfers ownership of your content to us.

You grant us only the limited permission we need to run the Service for you: to store the memory's structure and a small preview of each photo, to temporarily relay original photos and videos to the people you invite, to sync your memories across your own devices, and to help you restore your journal information. We do not use your family's photos, videos, or text for advertising, and we do not use them to train AI models or send them to third-party AI services. This permission ends when you delete the content or your account, except for content already shared with and saved by others, and for copies we're briefly retaining or are required to keep by law.

You're responsible for the content you add and share, and you represent that you have the right to share it with the people you invite.

4. How sharing and the relay work

MerryGo is private by design. Memories are shared only when you choose to share them, and only with the specific people you invite to a journal. There are no public profiles, no public feeds, and no discovery.

When you share a memory, we temporarily relay the original photos and videos through our servers so the people you invited can receive and save them. The original files are stored on our relay servers only for a limited period (currently up to 7 days) and are then removed. MerryGo is not a photo-storage or backup service. Your original photos and videos live in your own photo library, independent of MerryGo, and you're responsible for keeping your own copies. We keep the memory's structure and a small preview of each photo so you can organize, sync, and restore your journal information.

5. Saving memories

When someone shares a memory with you, you can choose which media to Save while the originals are still available through the relay. Saving is free and is never conditioned on a subscription.

In a shared Family Journal, Save makes your selected media durable for you within the same journal; it does not create a new entry or move the memory elsewhere. In a Class Journal, Save creates your own snapshot in the Family Journal you choose. In either case, later edits by someone else do not silently rewrite what you saved. You decide whether to accept any offered update.

Save is available only during the relay window. After an unsaved original expires, it cannot be saved unless the sender shares it again.

6. Acceptable use

Please use MerryGo only for its intended purpose — keeping and privately sharing family memories. You agree not to:

We may suspend or remove content or accounts that violate these Terms or that create risk for other families or for the Service.

7. Subscriptions and payments

Participation is free. Saving is free. Sharing is paid. You can use MerryGo, keep private journals, and save memories without paying. A subscription is required only when you choose to share a journal with others.

A subscription unlocks active collaboration and sharing — it does not determine ownership of memories you've already created. If a journal's subscription lapses or you cancel, its sharing pauses: new invitations are paused, but you keep access to your memories, and members keep access to what was already shared with them. We don't delete, hide, or lock your existing memories because a subscription ended.

8. Availability and changes to the Service

We work to keep MerryGo available and dependable, but the Service is provided on an "as is" and "as available" basis. We may add, change, or remove features over time. We'll try to give reasonable notice of significant changes that affect you. Because MerryGo doesn't permanently store your original media, you should keep your own copies of anything important to you.

9. Third-party services

MerryGo relies on services such as Apple (sign-in and subscriptions) and our cloud hosting and email providers. Your use of those services may also be governed by their own terms. We're not responsible for third-party services we don't control.

10. Termination

You can stop using MerryGo at any time and request account deletion at privacy@getmerrygo.com. We may suspend or end your access if you materially violate these Terms or use the Service in a way that harms others or the Service. Sections that by their nature should survive termination — such as content ownership, disclaimers, and limitation of liability — will continue to apply.

11. Disclaimers

To the fullest extent permitted by law, MerryGo is provided without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't warrant that the Service will be uninterrupted, error-free, or completely secure. You are responsible for maintaining your own copies of your original photos and videos.

12. Limitation of liability

To the fullest extent permitted by law, MerryGo and Harper LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data, memories, or content. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the twelve months before the claim, or, if you paid nothing, to fifty U.S. dollars. Some jurisdictions don't allow certain limitations, so some of these may not apply to you.

13. Governing law

These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws rules. Any dispute that isn't resolved informally will be handled in the state or federal courts located in New Hampshire, unless applicable law requires otherwise. We'd always rather resolve concerns directly — please reach out first.

14. Changes to these Terms

If we change these Terms, we'll post the updated version here and revise the effective date above. If a change is significant, we'll make reasonable efforts to let you know. Continuing to use the Service after a change takes effect means you accept the updated Terms.
